SHARK FILTRATION LLC

SHARK FILTRATION LLC

LIABILITY STATEMENT, DISCLAIMERS, AND
DISPUTE RESOLUTION

Effective Date: May 1, 2026

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE PURCHASING. IT LIMITS SHARK FILTRATION’S LIABILITY, REQUIRES BINDING ARBITRATION OF DISPUTES ON AN
INDIVIDUAL BASIS, AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR COLLECTIVE ACTION.

This Liability Statement governs your purchase, installation, and use of any product sold by Shark Filtration LLC (“Shark Filtration,” “we,” “us,” or “our”). It is incorporated into and forms part of our Terms of Sale.

  • a. Professional installation is strongly recommended. Shark Filtration strongly recommends that all products be installed by a licensed, qualified plumber. Water treatment equipment involves pressurized water lines, electrical connections, and connections to your home’s potable water supply. If you are not experienced with residential plumbing, stop and hire a licensed professional.
  • b. Code compliance is your responsibility. You are solely responsible for compliance with all applicable local, state, and federal plumbing, electrical, building, and water treatment codes; for obtaining any required permits; and for determining whether your jurisdiction requires installation by a licensed professional. This requirement varies by state, county, and municipality. Shark Filtration cannot advise you on what your jurisdiction requires.
  • c. Water source compatibility is your responsibility.You are solely responsible for verifying that the product you select is appropriate for your specific water source (municipal, well, or other), incoming water quality, water pressure, water temperature, and flow demand, and that all incoming water characteristics fall within the product’s specified operating parameters.
  • d. Pre-installation inspection is your responsibility. You are responsible for inspecting the product for any visible defects or damage before beginning installation. If you proceed to install a product with a known visible defect, that installation is not Shark Filtration’s responsibility and may void your warranty coverage.
  • e. Safety precautions are your responsibility. Before beginning any installation, you are responsible for: shutting off the main water supply and relieving line pressure; turning off electrical power to the installation area; confirming that incoming water pressure is within the product’s specified operating range (maximum 125 psi — see your product manual for the minimum); and otherwise preparing the installation site safely before work begins.
  • f. Leak and freeze protection is your responsibility. You are responsible for installing the product in a location protected from freezing temperatures at all times. You are responsible for installing a drip pan and/or a water leak detector beneath the unit if it is installed in a location where a leak could cause property damage. Shark Filtration recommends installation of a whole-home automatic water shut-off valve for additional protection. Ensuring accessible shut-off valves are present on both the inlet and outlet sides of the unit is your responsibility.
  • g. You assume all risk of self-installation. You assume all risk arising from your choice to self-install or to have a third party install any product purchased from Shark Filtration, including any property damage, water damage, mold, electrical damage, or personal injury resulting from improper installation, non-compliance with applicable codes, use of incompatible plumbing materials or fittings, or failure to follow the product manual. This assumption of risk applies to losses caused by improper installation, misuse, failure to follow the product manual, failure to comply with applicable codes, excessive water pressure, freezing, incompatible water conditions, incompatible fittings or materials, unauthorized modifications, neglect, or failure to maintain the product.

2. Installation Guides and Documentation

Any installation guide, instruction video, FAQ, technical bulletin, or other documentation provided by Shark Filtration through our website or otherwise is general informational guidance only. It is not professional plumbing, electrical, or engineering advice. Shark Filtration makes no warranty as to the accuracy, completeness, or applicability of any such material to your specific installation. Where anything in our documentation conflicts with the manufacturer’s instructions included with the product, the manufacturer’s instructions control in all cases.

3. Disclaimer and Limitation of Warranties

Except for the express Limited Warranty provided by Shark Filtration, and to the fullest extent permitted by applicable law, Shark Filtration disclaims all warranties not expressly stated in the Limited Warranty.

Because Shark Filtration provides a written Limited Warranty for consumer products, Shark Filtration does not disclaim any implied warranty that applicable law does not allow us to disclaim. To the extent permitted by applicable law, any implied warranties — including the implied warranties of merchantability and fitness for a particular purpose — are limited in duration to the same duration as the applicable coverage period set forth in the Limited Warranty for the specific product or component in question.

Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: (a) Scope of Exclusions. These exclusions apply to damages arising from improper installation, self-installation, failure to follow the product manual, failure to comply with applicable codes, excessive water pressure, freezing, incompatible water conditions, incompatible fittings or materials, misuse, unauthorized modification, neglect, or failure to maintain the product. To the fullest extent permitted by applicable law, Shark Filtration shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind whatsoever arising from such causes, including without limitation:
  • Water damage, flooding, or leaks of any kind;
  • Property damage of any nature;
  • Mold, mildew, or moisture-related damage or remediation costs;
  • Loss of use of your home or any portion thereof;
  • Interruption of water service or access to utilities;
  • Loss of revenue, income, profits, or business opportunity;
  • Cost of substitute goods or services;
  • Cost of removal, reinstallation, or re-plumbing;
  • Labor charges, plumber fees, or electrician fees;
  • Cost of temporary housing, hotel expenses, or relocation;
  • Increased utility bills or replacement water costs;
  • Inconvenience or loss of time; or
  • Claims made against you by any third party.
This exclusion applies regardless of the legal theory under which such damages are claimed — whether in contract, tort, negligence, strict liability, warranty, or any other legal or equitable theory — and applies even if Shark Filtration has been advised of the possibility of such damages, and even if any limited remedy provided herein is found to have failed of its essential purpose. (b) Liability Cap. To the fullest extent permitted by applicable law, Shark Filtration’s total cumulative liability to you arising out of or related to any product, any transaction, or these Terms — under any legal theory — shall not exceed the total purchase price actually paid by you to Shark Filtration for the specific product giving rise to the claim.  (c) Exceptions — What Cannot Be Limited. Nothing in this Liability Statement limits any liability that cannot be limited under applicable law, including:
  • Liability for personal injury caused by a defective product;
  • Liability for Shark Filtration’s gross negligence, recklessness, willful misconduct, or fraud;
  • Any rights under applicable consumer protection or warranty laws that cannot legally be waived or limited; or
  • Any other liability that applicable law does not permit to be excluded or limited.

5. Indemnification

You agree to indemnify, defend, and hold harmless Shark Filtration LLC and its members, officers, employees, contractors, and affiliates from and against third-party claims, demands, damages, losses, liabilities, fines, penalties, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or related to:

  • Your installation, modification, misuse, or failure to follow the product manual or applicable codes;
  • Damage to the property of any third party resulting from your installation or use of a product;
  • Personal injury to any third party resulting from your installation or use of a product;
  • Your breach of these Terms of Sale, this Liability Statement, or the Limited Warranty; or
  • False or misleading information you provided to Shark Filtration in connection with a purchase or warranty claim.

This indemnification obligation does not apply to the extent the underlying claim is caused by Shark Filtration’s own gross negligence, willful misconduct, fraud, or any liability that cannot be limited under applicable law.

6. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

6.1 Agreement to Arbitrate

You and Shark Filtration agree that any and all disputes, claims, or controversies between you and Shark Filtration arising out of or relating to your purchase, any product, your installation or use of any product, our Terms of Sale, our Limited Warranty, this Liability Statement, our website, or any advertising or marketing claims — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal or equitable theory, and whether arising before or after your purchase — shall be resolved exclusively by final, binding, individual arbitration, and not through a lawsuit in court.

6.2 Arbitration Administrator and Rules

Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, which are available at www.adr.org. The arbitration will be decided by a single neutral arbitrator. If the AAA is unavailable or unable to administer the arbitration, you and Shark Filtration will mutually agree on a substitute administrator; if you cannot agree within 30 days, a court of competent jurisdiction will appoint one.

6.3 Location and Format

Arbitration hearings will be conducted, at your election:

– In the county of your primary residence;

– By telephone or videoconference; or

– By written document submission only, without an in-person hearing.

You will not be required to travel to Texas or any other location to participate in arbitration.

6.4 Fees and Costs

Shark Filtration will pay all AAA filing, administration, and arbitrator fees to the extent required by the AAA Consumer Arbitration Rules. In consumer cases, you will generally pay no more

than a $225 filing fee; Shark Filtration pays remaining administrative fees and arbitrator compensation as required by the AAA Consumer Arbitration Rules. Each party is responsible for its own attorneys’ fees unless a statute applicable to the dispute requires otherwise or the arbitrator finds a claim to be frivolous.

6.5 Individual Basis Only — Class Action Waiver

YOU AND SHARK FILTRATION EACH AGREE THAT ALL DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS, AND NOT AS PART OF ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Neither you nor Shark Filtration may commence or participate in any class action, collective action, class arbitration, or representative proceeding. The arbitrator has no authority to consolidate the claims of multiple individuals or to preside over any form of class or representative proceeding. If a court determines that this class action waiver is unenforceable as to a particular claim, that claim only shall proceed in a court of competent jurisdiction; all other claims and the remainder of this arbitration agreement shall remain in full force and effect.

6.6 Jury Trial Waiver

YOU AND SHARK FILTRATION EACH KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY for any claim that proceeds in court, including any claim excluded from arbitration under Section 6.7.

6.7 Exceptions to Arbitration

The following claims are not subject to mandatory arbitration and may be brought in court:

– Small claims court — Either party may bring an individual claim that qualifies for small claims court in the county of your residence.

– Intellectual property — Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to protect intellectual property rights pending arbitration.

– Collections — Shark Filtration may bring a court action to collect undisputed amounts owed.

6.8 Thirty-Day Opt-Out Right

You have the right to opt out of this arbitration agreement. To exercise this right, you must send written notice of your decision to opt out to Shark Filtration within thirty (30) days of the date of your first purchase from Shark Filtration. Send your opt-out notice to:

– Email: sales@sharkfiltration.com (subject line: “Arbitration Opt-Out”)

– Mail: Shark Filtration LLC, Attn: Legal, 1937 N I-35 Frontage Rd, Suite 107, New Braunfels, TX 78130

Your opt-out notice must include your full name, email address, and the order number of your first Shark Filtration purchase. Opting out of arbitration does not affect any other provision of these Terms or this Liability Statement.

6.9 Survival

This entire Section 6 survives termination of these Terms, expiration of any warranty, completion of any transaction, and any opt-out of future purchases.

7. State Law Rights and Consumer Protection Savings Clause

Some states do not allow the exclusion or limitation of incidental or consequential damages, the limitation of implied warranty duration, or pre-dispute waivers of jury trial or class action rights. The limitations and exclusions in this Liability Statement may not apply to you to the extent prohibited by the law of your state of residence.

Nothing in this Liability Statement waives or limits any rights you may have under the Texas Deceptive Trade Practices–Consumer Protection Act, or under any other applicable state consumer protection law, to the extent those rights cannot legally be waived or limited.

This Liability Statement gives you specific legal rights. You may also have other rights that vary from state to state.

8. Governing Law and Venue

Shark Filtration is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including without limitation acts of God, fire, flood, severe weather, earthquake, war, terrorism, civil disturbance, labor disputes, pandemic, governmental action, carrier delays, supply chain disruption, or failure of utilities, internet, or telecommunications infrastructure.

10. No Waiver

Shark Filtration’s failure or delay in enforcing any provision of these Terms at any time does not constitute a waiver of our right to enforce that provision or any other provision at any later time.

11 Severability

If any provision of this Liability Statement is found by a court or arbitrator to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be modified. All remaining provisions continue in full force and effect. Notwithstanding the foregoing, if the class action waiver in Section 6.5 is found unenforceable as to any particular claim, that claim only shall proceed in court; the remainder of the arbitration agreement in Section 6 remains fully enforceable.

12. Entire Agreement

This Liability Statement, together with the Terms of Sale, the Limited Warranty, and the Privacy Policy, constitutes the entire agreement between you and Shark Filtration regarding the subject matter hereof, and supersedes all prior or contemporaneous agreements, representations, and understandings between the parties.

13. Legal Notices

All legal notices to Shark Filtration must be sent in writing to:

Shark Filtration LLC Attn: Legal 1937 N I-35 Frontage Rd, Suite 107 New Braunfels, TX 78130 Email: sales@sharkfiltration.com

By checking the box at checkout and placing your order, you confirm that you have read and agree to this Liability Statement, including the limitation of liability, the disclaimer of warranties, the binding individual arbitration agreement, the class action waiver, and the jury trial waiver. You understand you may opt out of arbitration within 30 days of your first purchase.

This Limited Warranty is given in lieu of all other express warranties. No Shark Filtration employee, representative, dealer, reseller, or other party is authorized to make any warranty other than the warranty expressly set forth in this document. This warranty gives you specific legal rights. You may also have other rights that vary from state to state.
